Understanding the Divorce Process
- Initial Consultation: The process typically begins with an initial consultation with a family law solicitor. During this meeting, you can discuss your situation, concerns, and your options moving forward.
- Ground for Divorce: In the UK, there is now only one ground for divorce: the irretrievable breakdown of the marriage. There is no longer any need to prove a breakdown with evidence of any adultery, unreasonable behaviour, separation etc.
- Issuing a Divorce Application: The next step is to issue a divorce application with the court. This document outlines the details of the marriage, reason for divorce and the nature of any financial claim. The process is generally initiated online.
- Responding to the Application: If you receive a divorce application, you will have the opportunity to respond, although the possibility of contesting a divorce, should you wish to do so, is generally more limited these days.
- Conditional Order: Once 20 weeks (the period of reflection) has passed from the date of issue of the divorce application, you can apply for a conditional order. The court will consider the application and if agreeable will grant a conditional order. The conditional order does not end your marriage.
- Final Order: After a further waiting period of at least six weeks and one day from the granting of your conditional order, you can apply for a final order. If you are the person in receipt of a divorce application, you will need to wait a further three months, before you can apply for the Final Order. A Final Order dissolves your marriage completely.
- Financial and Property Matters: Should you wish to make a financial and/or property order, it may be advisable to resolve all such issues, prior to the making of the Final Order and it is advisable to seek legal advice about this.
